Terms of Service

1. Acceptance of Terms

By accessing or using the TellMe service, website, and software provided through or in connection with the service, including through a mobile device (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify TellMe of any unauthorized use of your account or any other breach of security.

4. User Content

You are solely responsible for the content that you post, upload, publish, link to, or otherwise make available via the Service. You agree not to post content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
  • Harasses, degrades, intimidates, or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability
  • Includes personal or identifying information about another person without that person's explicit consent
  • Impersonates any person or entity, including TellMe employees or representatives
  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any party
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Harass, threaten, or defraud other users
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks
  • Use any robot, spider, crawler, scraper, or other automated means to access the Service
  • Develop or use any applications that interact with the Service without TellMe's prior written consent

6. Termination

TellMe reserves the right to terminate or suspend your account and access to the Service at any time, without notice, for conduct that TellMe believes violates these Terms or is harmful to other users of the Service, TellMe, or third parties, or for any other reason at TellMe's sole discretion.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL TELLME, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Changes to Terms

TellMe reserves the right to modify or replace these Terms at any time. If a revision is material, TellMe will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at TellMe's sole discretion.
